Please note the following: The sponsor commitment deadline is May 15, 2024 If you want your logo to appear on Fiesta del Sol promotional materials. Your sponsor commitment deadline is April 1, 2024. Your space in NON-REFUNDABLE. If you cancel, SBCC will attempt in good faith to fill your space. If space is filled, it will be at the sole discretion of SBCC to issue a refund. Limitation of Liability: By agreeing to become a sponsor, sponsor acknowledges and agrees that Solana Beach Chamber of Commerce (SBCC) shall not be liable to sponsor or any third party for any damages or losses to persons or property, whether direct, indirect, special or consequential; however, if the Fiesta del Sol is cancelled or the City of Solana Beach or SBCC terminated this sponsorship for any reason (other than sponsor’s wrongdoing, breach of the agreement or any other agreement with SBCC, or failure to pay monies due to SBCC) sponsor shall be entitled to a refund of it’s sponsorship fees. Sponsor booths are based on a first come, first served basis. This agreement (and the specific items agreed to in the “sponsorship levels’ description) are the sole agreement between SBCC and sponsor with respect to the subject matter herein, and supersedes all prior oral and written agreements between the parties. In the event of a dispute between the parties, the parties agree to resort solely to the Federal and State courts located in San Diego County; the prevailing party in any litigation shall be entitled to their attorney’s fees and costs. SBCC shall be entitled to obtain interest or past due amounts, in the amount of seven percent (7%) per annum. In submitting this application, sponsor agrees to sponsor Fiesta del Sol and comply with the provision of this contract.
